Hi guys

I am contemplating will I WILL build a 13000l koi pond soon but I do live in a sectional title complex. Please bear in mind I am in a cluster and have no houses joined to me at all. What is the legislation around this? And can the !@#$%^ trustees object to something like this?

Surely its ok? haha there is nothing in the contract that states anything about koi ponds but possibly when I ask they may just decide no.

Is that legal? We have swimming pools in the complex so how can koi ponds not be legal?

The typical registered Sectional Title rules state that the Trustees must approve of all external improvements. However, if they object without any valid reason, you can approach the Court for its approval/permission, and if the Court approves, the Body Corporate has to pay the legal fees. Therefore, they will only object if they really have a valid reason.

If your pond does not affect the aesthetics of the complex negatively, the Court will grant permission.

Normally the Trustees have no objection, provided that you adhere to all building regulations.
